These terms apply to your use of the Mobol website. They are not the agreement for any paid work we do for you; that is covered by a separate written proposal or services agreement. By using this site, you agree to these terms.

Who we are

This website is operated by Mobol, a registered business name of a sole trader based in Perth, Western Australia (ABN 81 902 687 376). You can reach us at hello@mobol.com.au. In these terms, “we”, “us” and “our” mean Mobol, and “you” means anyone who uses this website.

About these terms

These terms govern your use of the website: browsing it, reading our Insights articles, and sending us an enquiry. Using the site means you accept them; if you don’t agree, please don’t use the site.

The website describes our services (web development, AI integration, SEO, social media and reputation management). Those descriptions are general information, not a binding offer, and outcomes for services like SEO and social often depend on third-party platforms and market factors, so results aren’t guaranteed. A specific engagement only exists once we’ve agreed scope, fees and timing in writing. If anything in these website terms conflicts with a signed proposal or services agreement for specific work, that signed agreement prevails for that work.

Using the website

When using the site, you agree not to:

  • use it unlawfully or for any unlawful purpose;
  • probe, scan, attack, or try to gain unauthorised access to the site or its admin areas, or bypass its security;
  • scrape, harvest or reproduce content beyond ordinary browsing, or upload malicious code;
  • submit false, deceptive, abusive or rights-infringing content through any form.

We may suspend or block access if these terms are breached.

Intellectual property

We (and our licensors) own this website and everything on it, including its design, code, text, our Insights articles, our brand and logo, which are protected by Australian and international copyright laws. We give you a limited, personal, non-transferable licence to view and use the site to learn about and evaluate our services. You may not copy, scrape, republish, modify or commercially reuse any part of it without our written permission.

Content you submit

If you send us anything through this site (for example, details in our enquiry form), you keep ownership of it. You confirm you’re allowed to share it and that it’s lawful, and you give us a non-exclusive, royalty-free licence to use it for the limited purpose of responding to and managing your enquiry.

AI features

We may add an AI assistant to this website in the future. It is not available yet; we do not currently operate an AI chat on this site or send your information to any AI provider through it. If and when we launch one, anything it says will be general information only (not professional, legal, financial or technical advice), may not always be accurate or complete, and additional terms will apply at that time.

Your consumer rights

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), or any other law, where doing so would be unlawful. If any part of these terms would otherwise have that effect, it doesn’t apply to that extent, and the rest keeps working. Where the ACL applies and can’t be excluded, these terms are read subject to it.

Where the ACL applies to services we supply, those services come with guarantees that can’t be contracted out of, including that they will be provided with due care and skill, will be reasonably fit for any purpose you tell us about, and will be supplied within a reasonable time where we haven’t agreed one.

Liability

To the extent permitted by law, and except where the services are of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to meet a consumer guarantee for services is limited, at our option, to: (a) supplying the services again; or (b) paying the cost of having them supplied again. This limit doesn’t apply where it wouldn’t be fair or reasonable, or where the law doesn’t allow it.

Subject to your consumer rights above and to the extent permitted by law: the website is provided on an “as is” and “as available” basis; we’re not liable for indirect or consequential loss, loss of profit, revenue, goodwill or data, or loss arising from third-party websites or services or from how you use information on this site; and our total liability connected with the website is limited to the greater of AUD $100 or the amount you paid us for the relevant services giving rise to the claim. None of this limits liability that can’t be limited by law.

Privacy

How we handle information and tracking is set out in our Privacy Policy and Cookie Policy. We use a notice-based approach (we tell you what’s running rather than using a consent pop-up), which is the appropriate approach in Australia.

If something goes wrong

If a dispute comes up, let’s try to sort it out directly first: email hello@mobol.com.auand we’ll genuinely try to resolve it in good faith. If we can’t resolve it within a reasonable time, we’ll consider mediation through a recognised Western Australian service before going to court. Nothing here stops you from contacting Consumer Protection WA or the ACCC, or from exercising any right you have to take a matter to a court or tribunal, and either of us can still seek urgent court orders if needed.

Governing law

These terms are governed by the laws of Western Australia and the Commonwealth of Australia as they apply in Western Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia.

Changes and general

We may update these terms from time to time; the “last updated” date reflects the latest version, and continued use after a change means you accept it. If any part of these terms is found to be unenforceable, it’s severed and the rest keeps working. Sections that by their nature should survive, including intellectual property, your consumer rights, liability, and governing law, continue to apply after you stop using the site.
